Working Group on Arbitrary Detention
Reports to the Commission on Human rights
Each year the Working Group reports to the Commission on its activities. In the report, the Working Group will express its observations on the different institutions, legal insufficiencies, policies, judicial practices which, in its opinion, are the cause for the occurence of cases of arbitrary deprivation of liberty. In its conclusions, the Working Group has made critical comments on abuses of states of emergency, of criminal legislation which fails to define criminal offences with sufficient precision, excessive recourse to special tribunals, particularly military courts, absence of an independent judiciary or bar association, violations of the right to freedom of expression and opinion, etc. (See Annual Report, Fact Sheet n.26).
